These terms and conditions set out the rules and regulations for the use of the Merakitrip, Unipessoal LDA website, available at https://www.merakitrip.com.
1. Scope and Object of the General Conditions of Sale
These General Conditions, together with the order form and other elements referred to therein, are intended to regulate the terms and conditions governing the provision of the Online Store Service by Merakitrip—headquartered at Rua Senhora do Monte, No. 18, 1170-361 Lisbon, and registered under the unique corporate identification number 517828880.
The Service consists of providing access to the Online Store via the address https://www.merakitrip.com. In addition to providing information on a range of products and/or services, the site allows users to electronically order the products advertised there, subject to the terms and conditions described herein.
Orders for services must be placed by users aged 18 (eighteen) or older (minors under this age must obtain authorization from their legal representatives). The details and information provided by the User shall have full legal effect; the User acknowledges the electronic purchases made and may not cite the absence of a signature to justify non-compliance with the obligations undertaken.
2. Information about Products and Content
Merakitrip strives to ensure that the information presented is free of typographical errors; any such errors will be promptly corrected. If you purchase a product with characteristics that differ from those displayed online, you have the right to terminate the purchase contract in accordance with applicable laws (right of withdrawal without cause – see section 9).
Merakitrip makes every effort to ship all ordered products; however, in certain instances—due to factors beyond Merakitrip's control, such as human error or IT system issues—it may not be possible to supply one or more of the products ordered by the User. If a product becomes unavailable after an order has been placed, you will be notified via email or telephone. You will then be offered the option to cancel the order and receive a refund, provided payment has already been made.
All information regarding prices, products, specifications, promotional activities, and services is subject to change by Merakitrip at any time.
3. Responsibilities
3.1 All products and services sold in the Merakitrip Online Store comply with Portuguese legislation.
3.2 The Store employs adequate security measures; however, Merakitrip shall not be held liable for any damages suffered by the User and/or third parties arising from delays, interruptions, errors, or suspensions in communications caused by factors beyond its control—specifically, deficiencies or failures in the communications network or services provided by third parties, computer systems, modems, connection software, or computer viruses, or resulting from the downloading of files containing viruses or other properties that may affect the User's equipment. If, for any reason involving an error in accessing the Merakitrip Online Store website, it becomes impossible to provide the service, Merakitrip shall not be held liable for any damages.
3.3 Data and information queries made within the scope of this Service are presumed to have been performed by the User, and Merakitrip disclaims any liability arising from the abusive or fraudulent use of the information obtained.
3.4 Merakitrip shall not be liable for any losses or damages caused by improper use of the Service that are not directly attributable to it through willful misconduct or gross negligence.
3.5 Merakitrip shall not be held liable for any losses or damages arising from non-performance or defective performance of the Service when such is not directly or indirectly attributable to it through willful misconduct or gross negligence, and, in particular, shall not be held liable for:
(i) errors, omissions, or other inaccuracies regarding the information made available through the Service;
(ii) damages caused by the fault of the User or third parties, including intellectual property violations;
(iii) non-performance or defective performance resulting from compliance with court orders or decisions by administrative authorities; or
(iv) non-performance or defective performance resulting from force majeure events—that is, extraordinary or unforeseeable situations beyond Merakitrip’s control, such as fires, power outages, explosions, wars, riots, civil unrest, government decisions, strikes, earthquakes, floods, or other natural disasters, or other situations beyond Merakitrip’s control that prevent the User from using the Service.
3.6. Merakitrip Tours does not guarantee that:
i) the Service will be provided without interruption, be secure, be error-free, or operate indefinitely;
ii) the quality of any product, service, information, or other material purchased or obtained through the Service will meet the User's expectations regarding the same;
iii) any material obtained in any way through the Service is used at the User's own risk, and the User is solely responsible for any damage caused to their computer system and equipment or for any loss of data resulting from such use;
iv) no advice or information, whether oral or written, obtained by the User from or through the Service shall constitute any warranty not expressly stated in these General Conditions.
3.7. The User agrees that Merakitrip cannot be held liable in any way for any damages, including, but not limited to, damages for lost profits, loss of data or content, or any other losses (even if previously advised by the User of the possibility of such damages occurring), resulting from:
i) the use or inability to use the Service;
ii) the difficulty in obtaining any substitute goods/services;
iii) unauthorized access to or modification of personal databases.
4. Consumer Obligations
4.1. The user undertakes to:
i) Provide correct personal data and addresses;
ii) Not use false identities;
iii) Respect the imposed order limits.
4.2 If any data provided is incorrect or insufficient, resulting in a delay or inability to process the order, or non-delivery, the User bears full responsibility, and Merakitrip is absolved of any liability. Should the consumer violate any of these obligations, Merakitrip reserves the right to prevent future purchases, block access to the store, cancel the provision of any other services simultaneously made available by Tuker Lisbon Tours to the same user, and deny the user future access to any or all services provided by Merakitrip.
4.3 It is expressly prohibited to use the purchased products and services for commercial purposes, specifically for the resale of goods.
5. Privacy and Personal Data Protection
5.1. Merakitrip guarantees the confidentiality of all data provided by Users.
5.2 Personal data identified as mandatory on the order form is essential for Merakitrip to provide the Service. The omission or inaccuracy of data provided by the User is the User's sole and exclusive responsibility and may result in Merakitrip refusing to provide the Service.
5.3 The User's personal data will be processed and stored electronically and is intended for use by Merakitrip within the scope of the contractual and/or commercial relationship with the User.
5.4 In accordance with applicable legislation, the User is guaranteed the right—free of charge—to access, rectify, and update their personal data, either directly or via a written request, as well as the right to object to its use for the purposes set out in the preceding paragraph; to exercise these rights, the User must contact the entity responsible for personal data processing at: info@merakitrip.com.
5.5 The Internet is an open network; therefore, the User's personal data, other personal information, and all content hosted on the Service may circulate across the network without security safeguards, carrying the risk of access and use by unauthorized third parties. Merakitrip cannot be held liable for such access and/or use.
6. Cancellation of reservations
6.1 At the User's Request
The User may cancel their booking by contacting Merakitrip via telephone or email—providing the booking number—within 7 days of making the booking.
6.2 At Merakitrip's Discretion:
Merakitrip reserves the right not to process bookings if it detects inconsistencies in the personal data provided or observes improper conduct by the purchaser. Merakitrip reserves the right not to process any booking or refund in the event of errors regarding prices and/or product specifications caused by technical issues or errors beyond Tuker Lisbon Tours' control.
6.3 Refunds
Merakitrip reserves the right to issue refunds using the same payment method originally used—at no cost to the customer—within a maximum period of 14 days. If a refund is requested via a different method, any additional costs incurred will not be reimbursed.
7. Intellectual property
7.1 The Store is a registered website, and the Service provided by the site itself is the responsibility of Merakitrip.
7.2 The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property rights, and other applicable legislation.
7.3 The User acknowledges that any content included in advertisements, featured items, promotions, or mentions regarding any sponsor or advertiser is protected by copyright and related rights laws, industrial property laws, and other property protection laws; therefore, any use of such content may only occur with the express authorization of the respective rights holders.
7.4 The User undertakes to fully respect the rights referred to in the preceding paragraph, specifically by refraining from any acts that might violate the law or said rights—such as the reproduction, commercialization, transmission, or making available to the public of such content, or any other unauthorized acts involving said content.
8. Service Safety Conditions
8.1. The User undertakes to comply with all applicable legal provisions—specifically, to refrain from committing or encouraging acts that are unlawful or contrary to accepted standards of conduct, such as the indiscriminate sending of unsolicited communications (spam) in violation of legislation governing the processing of personal data and advertising communications via automated calling devices. The User must also comply with the rules for using the Service; failure to do so may result in Merakitrip suspending or deactivating the Service as provided for in Section 14.
8.2. The User expressly acknowledges and accepts that the IP Network is a public electronic communications network used by multiple users and is, as such, subject to network congestion; therefore, Merakitrip does not guarantee that the Service will be provided without interruptions, data loss, or delays.
8.3. Merakitrip likewise does not guarantee the provision of the Service in the event of unforeseeable system overload or force majeure (situations of an extraordinary or unforeseeable nature that are beyond Merakitrip’s control).
8.4. In the event of a service interruption due to unforeseeable system overload, Merakitrip undertakes to restore normal operation as quickly as possible.
9. Suspension and deactivation of the Store Service
9.1 Regardless of any prior or subsequent notice, Merakitrip may, at any time and at its sole discretion, cease making the Service and/or part of the Service available to one or all Users.
9.2 Merakitrip also reserves the right to immediately suspend or terminate access to the Service in the following cases:
a) When the User fails to comply with the conditions of use referred to in point 4 and others referred to in the General Conditions;
b) When Merakitrip accesses the Store, subject to 15 days' prior notice before the termination date.
9.3 The suspension or termination of the Service by Merakitrip under the terms of the preceding paragraphs does not entitle the User or any third party to any indemnity or other compensation, and Merakitrip shall not be held liable or otherwise burdened for any consequence resulting from the suspension, cancellation, or termination of the Service.
9.4 In the situations described above, Merakitrip will notify the User in advance so that the User may, if they so wish, safeguard the content of their order viewing area within 3 (three) business days of the email being sent or the information being made available on the Service's main page.
10. Communications
10.1 Without prejudice to other forms of communication provided for in these General Terms and Conditions, notifications addressed to the User regarding the Service, including any amendments to these General Terms and Conditions, may be sent to the User's email address, via SMS, or by telephone.
10.2 The User agrees to receive any communication and/or notification related to the Online Store at the address, contact telephone number, and/or email address ("email") provided during the ordering process. At any time, the User may request not to receive such communications and/or notifications by using the Contact Form or by selecting the "Do not receive the Newsletter" option included in each Newsletter.
11. Technical Settings
11.1 Without prejudice to the provisions of the following paragraph, Merakitrip may modify the Service and/or the technical conditions under which it is provided, as well as the applicable usage rules, and must inform the User of such changes at least 15 (fifteen) days in advance.

12. Communications
12.1 Whenever Merakitrip deems it necessary or expedient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reconfigure network settings.
12.2 Without prejudice to the provisions of the following paragraphs, and taking into account the innovative nature of the Service and the technological developments to which it may be subject, Merakitrip may modify its technical configurations whenever it deems it expedient to adapt the Service to potential technological developments.
12.3 However, Merakitrip does not guarantee the User any updates or improvements to the Service.
12.4 Certain updates or new features of the Service may only be available upon payment by the User and/or the User's subscription to Specific Terms of Use.
13. Complaints
13.1 The User may submit any contractual disputes to arbitration and mediation mechanisms that are or may be legally established, as well as file complaints with Merakitrip regarding acts and omissions that violate legal provisions applicable to the purchase of goods.
13.2 The complaint must be submitted within a maximum of 30 (thirty) days from the date the User becomes aware of the facts and will be recorded in Merakitrip’s information systems; Merakitrip shall decide on the complaint and notify the interested party within a maximum of 30 (thirty) days from the date of the complaint.
Governing Law:
The contract is governed by Portuguese law.
